El análisis de las garantías constitucionales de las niñas pertenecientes a comunidades indígenas en Colombia, respecto a circunstancias que representan una afectación de sus derechos se concreta con la figura del matrimonio infantil o uniones tempranas. Es así que, el presente estudio evidencia una aproximación sobre la garantía de los derechos de las niñas a decidir sobre la unión marital de hecho pertenecientes a pueblos tribales en Colombia. En ese sentido, el propósito de la presente investigación se centra en realizar un análisis al pueblo tribal Kankuamo, lo cual permitirá un acercamiento directo con el fin de conocer los derechos de las niñas y los mecanismos que implementan dentro del territorio indígena para garantizarlo, dada la realidad actual de los pueblos tribales, en cuanto a la normativa referente a ellos, la jurisprudencia y las interacciones de esta comunicad con la sociedad civil. Finalmente, el desarrollo de este estudio parte de una metodología con enfoque crítico-social, de tipo explicativo-descriptivo, con un método cualitativo-cuantitativo, lo cual permite a los investigadores el desarrollo efectivo de los objetivos formulados, además de resolver la pregunta problema; es por ello, que se recurrió a documentos que permitieron profundizar en la temática a la luz de la normatividad vigente y el análisis jurisprudencial; del tal forma que dicha investigación se caracterizó en su desarrollo por el conjunto de procesos que permitan captar la información a estudiar sobre el contexto analizado y valorar dicha información según el insumo teórico doctrinal, jurisprudencial y normativa.

The analysis of the constitutional guarantees of girls belonging to indigenous communities in Colombia, regarding circumstances that represent an affectation of their rights, is specified with the figure of child marriage or early unions. Thus, the present study shows an approach on the guarantee of the rights of girls to decide on the de facto marital union belonging to tribal peoples in Colombia. In this sense, the purpose of this research is focused on carrying out an analysis of the Kankuamo tribal people, which will allow a direct approach in order to know the rights of girls and the mechanisms that they implement within the indigenous territory to guarantee it, given the current reality of the tribal peoples, in terms of the regulations referring to them, the jurisprudence and the interactions of this community with civil society. Finally, the development of this study is based on a methodology with a critical-social approach, of an explanatory-descriptive type, with a qualitative-quantitative method, which allows researchers the effective development of the formulated objectives, in addition to solving the problem question. ; For this reason, documents were used that allowed to delve into the subject in light of the current regulations and the jurisprudential analysis; in such a way that said research was characterized in its development by the set of processes that allow capturing the information to be studied about the analyzed context and assessing said information according to the doctrinal, jurisprudential and normative theoretical input.
