La industria del arte cinematográfico genera impactos socioeconómico, cultural y patrimonial en Colombia, pero las fases de distribución y exhibición tienen algunas inconsistencias. Esta investigación se enfoca en las dificultades del retorno de la inversión. Para proponer una posible solución se aplica la hermenéutica en la Ley de Cine (Ley 814 de 2003), se obtiene y analiza la perspectiva de los entrevistados, investigaciones sobre industria cinematográfica y el resumen estadístico cinematográfico. El objetivo de esta investigación jurídico-propositiva es determinar las medidas que mitiguen las dificultades del retorno de la inversión en la industria cinematográfica colombiana y su inclusión en la legislación nacional vigente sobre distribución y exhibición fílmicas. Se detectó la ausencia de cuota de pantalla y una Industria Cinematográfica en proceso de consolidación, las estadísticas cinematográficas oficiales demostraron que la relación entre la taquilla exitosa, una fuerte estrategia publicitaria y la continuidad (tiempo de permanencia en exhibición) coadyuvan al retorno de la inversión. Los entrevistados pertenecen a las áreas de distribución, producción, dirección, docencia e investigación, y manifestaron su perspectiva sobre la actividad cinematográfica y los inconvenientes por solucionar y mejorar. La propuesta para mitigar las dificultades del retorno de la inversión en la industria cinematográfica presenta requerimientos de mercadeo y publicidad, regionalización de la obra cinematográfica, condiciones de realización y entrega de la película nacional y la importancia de regular la cuota de pantalla. Debido a la trascendencia cultural y patrimonial del cine nacional, se precisa que la comunidad académica participe en el estudio del Derecho Cinematográfico colombiano, una asignatura poco explorada pero que cuenta con diversos campos de acción que necesitan ser abordados mediante investigaciones jurídicas que aporten propuestas de mejoramiento de las condiciones de la actividad cinematográfica nacional para la consolidación de esta industria en el país.

The Film Art Industry generates socioeconomic, cultural, and heritage impacts in Colombia, but there are some inconsistencies between the genuine film industry and the distribution and exhibition phases. This research focuses on the difficulties of return on investment. A possible solution is proposed by applying hermeneutics in the Film Law (Law 814 of 2003), obtaining, and analyzing the perspective of the interviewees, the investigations about the film industry, and the film statistics summary. The objective of this legal-purpose investigation is to determine the measures that mitigate the difficulties of return on investment in the Colombian film industry and include them in current national legislation about film distribution and exhibition. The investigation detected the absence of the Screen Quota and a Film Industry in the process of consolidation, official film statistics demonstrate that the return on investment is induced by the connection between the successful box office, a strong marketing strategy, and continuity (time on exhibition). The interviewees belong to the areas of distribution, production, direction, teaching, and research, they expressed their perspective on film activity and the inconveniences to be solved and be improved. The proposal to mitigate the difficulties of return on investment in the film industry presents marketing and advertising requirements, regionalization of the cinematographic work, conditions of realization and delivery of the film, and the importance of regulating the screen quota. Due to the cultural and heritage significance of national cinematographic art, the academic community also should study Colombian Film Law, explore the diverse cinematographic action fields through legal research, and provide proposals to improve the conditions of national film activity, for the consolidation of this industry in the country.
