El presente estudio tiene por objetivo analizar los factores que determinan la responsabilidad del Estado colombiano con ocasión de fatalidades en accidentes mineros en pequeña minería del carbón, por medio de un estudio cualitativo. Para la ejecución del proyecto se definió una metodología basada en el enfoque cualitativo, ya que principalmente permite el abordaje reflexivo e implementación de estrategias y análisis interpretativos sobre significados, conceptos y determinaciones no cuantificables. Se tomó como muestra o participantes 5 casos de estudio y revisión general de la normatividad. En concordancia con los resultados obtenidos, se logró determinar que a nivel de la legislación colombiana hay normas que permiten establecer parámetros para la regulación de la actividad minera y como de allí se pueden proponer acciones para la prevención de daños fatales y de cómo poder accionar la reclamación de la responsabilidad del estado por tales hechos. Con base a los resultados se concluyó que los factores que determinan la responsabilidad del estado colombiano con ocasión de fatalidades en accidentes mineros está sustentado principalmente por fallos en el servicio u omisiones en las responsabilidad que tiene la autoridad minera, lo que ocasiona una responsabilidad subjetiva y acorde a ello se determinó que es fundamental el mejoramiento de estos procesos desde la revisión de los casos en los cuales la autoridad minera se ha visto como responsable del estado.

The objective of this study is to analyze the factors that determine the responsibility of the Colombian State on the occasion of fatalities in mining accidents in small coal mining, by means of a qualitative study. For the execution of the project, a methodology based on the qualitative approach was defined, since it mainly allows the reflective approach and implementation of strategies and interpretative analysis of meanings, concepts and non quantifiable determinations. Five cases of study and general revision of the regulations were taken as sample or participants. In accordance with the results obtained, it was possible to determine that at the level of the Colombian legislation there are norms that allow to establish parameters for the regulation of the mining activity and how from there actions can be proposed for the prevention of fatal damages and how to be able to operate the claim of the responsibility of the state for such events. Based on the results, it was concluded that the factors that determine the responsibility of the Colombian state on the occasion of fatalities in mining accidents are mainly sustained by service failures or omissions in the responsibility of the mining authority, which causes a subjective liability and According to this, it was determined that the improvement of these processes is fundamental from the review of the cases in which the mining authority has been responsible for the state.
