El sistema Penal de Adolescentes desde su implementación en la ciudad de Cúcuta viene presentado estadísticas que reflejan incremento en el número de adolescentes que participan en 11 conductas delictivas y de igual forma las cifras de reincidencia según investigaciones del Centro de estudios de la Procuraduría está entre el 40 y 45 por ciento; datos que generan discusión respecto de las sanciones pedagógicas que se caracterizan por su flexibilidad y carácter pedagógico. El estudio tiene como objetivo identificar los factores socio-jurídicos que intervienen en la reincidencia de conductas delictivas de jóvenes infractores que habiendo estado cumpliendo sanción pedagógica dentro del sistema penal de adolescentes reingresa nuevamente como menor o al sistema penal de adultos. Se aplicó encuesta a un grupo de jóvenes del centro especializado para adolescentes que son reincidentes y a un grupo de jóvenes que están en el centro carcelario de adultos y que habían cumplido sanción pedagógica como menores.

The Criminal System of Adolescents since its implementation in the city of Cúcuta has been presented statistics that reflect an increase in the number of adolescents participating in criminal behavior and similarly the recidivism figures according to the research of the Office of the 13 Attorney General is between 40 and 45 percent; data that generate discussion regarding the pedagogical sanctions that are characterized by their flexibility and pedagogical character. The objective of the study is to identify the socio-legal factors that intervene in the recidivism of delinquent behavior of young offenders who, having been serving a pedagogical sanction within the penal system of adolescents, re-enter again as a minor or into the penal system of adults. A survey was applied to a group of young people from the specialized center for adolescents who are repeat offenders and to a group of young people who are in the adult prison and who had served as pedagogical sanctions as minors.
