Colombia es un país de contraste, puesto que hay un país en un extremo desarrollado y en otro una Colombia marginal, este estudio pretende resaltar el desconocimiento del principio de integralidad a la hora de prestar el servicio de salud de su población y su relación con la eficiencia y oportuna calidad de la misma, Colombia posee 1.098 municipios, con proyección a aparecer cada año nuevos municipios por lo tanto el proceso de selección de los beneficiarios no garantiza, por si solo la equidad territorial de la distribución de los subsidio, por lo que o existía un criterio territorial cuando apareció el régimen subsidiado financiado principalmente con recursos del FOSYGA, asignado por el CNSSS. Según la ley 1751 de 2015, estableció que la salud es un derecho fundamental que se define como “La facultad que tiene todo ser humano de mantener la normalidad orgánica funcional, tanto física como en el plano de la operatividad mental, y de restablecerse cuando se presente una perturbación en la estabilidad orgánica y funcional de su ser”. Se ha indicado que tal derecho se debe garantizar en condiciones de legalidad dado que su materialización resulta indispensable para el ejercicio de otros derechos fundamental. El Estado debe respetar, proteger y garantizar el derecho a la salud, reduciendo la mortinatalidad y la mortalidad infantil y el sano desarrollo de los niños, el mejoramiento de todos los aspectos de la higiene del trabajo y del medio ambiente, la prevención y el tratamiento de las enfermedades epidémicas, endémicas, profesionales y de otra índole y la lucha contra ellas, la creación de condiciones que aseguren a todos asistencia médica y servicios médicos en caso de enfermedad.
