    This research paper discussed whether the Colombian State guarantees the fundamental rights to water, health and education of the indigenous human group Wayuu of the beach community, in Uribía la Guajira within the framework of its uses, customs and worldview. In order to analyze this situation of the guarantee of these constitutional rights was carried out through a qualitative descriptive investigation, which consisted through fieldwork, perception and interviews with the community, to know first hand the situation of this community and in turn its needs, and knowing in turn, whether the Colombian State guarantees its fundamental rights to water, health and education taking into account its culture and tradition. The results of this research show that the Colombian State does not guarantee the rights of water, education and health to the Wayuu indigenous people of the beach community located in Uribía, the Guajira within the framework of its uses, customs and worldview. Therefore, it was concluded that the way in which the Colombian State should guarantee the aforementioned rights to this population should be through the guidelines of its customs, in turn, must go hand in hand with sustainable development and this with e the purpose of this constitutional guarantees to last in time.
