En este proyecto de investigación se buscó llevar a cabo un análisis integral de la situación de los conductores de taxi frente a la materialización del derecho a la seguridad social, teniendo en cuenta a aquellos que se encuentran en San José de Cúcuta. Este estudio está impulsado desde el enfoque cualitativo y desde la tipología descriptiva. Esas bases metodológicas, las cuales fueron complementadas con las técnicas denominadas análisis documental y entrevista, se desarrollaron unos resultados basados en reconocer cómo está compuesto el marco jurídico que regula la integración de los conductores del servicio público de taxi al Sistema de Seguridad Social, además de establecer qué dice la doctrina teniendo presente que existe un contrato individual de trabajo, un conductor que funge como trabajador independiente y uno que es contratista. De igual modo, se identificaron los conceptos de los líderes de este gremio en Cúcuta sobre el alcance del derecho a la seguridad social para ellos. Según los entrevistados, la normatividad que regula las generalidades sobre el acceso al derecho a la seguridad social no tiene en cuenta las características especiales que posee el oficio de ser taxista; es decir, no se encuentran debidamente delimitadas las situaciones relacionadas con la vinculación al Sistema General de Seguridad Social (contrato individual de trabajo, contratista y trabajador independiente). Por ese motivo, se sugirió tanto las entidades municipales, las empresas de servicio público de transporte terrestre en vehículos tipo taxi y los representantes del Gobierno Nacional puedan realizar un análisis más profundo sobre el alcance del derecho a la seguridad social en ese ámbito y así evaluar las causas que llevan a que no se produzca una plena integración al Sistema General de Seguridad Social. Contando con datos más puntuales será posible fundamentar conversaciones con mejores argumentos y con soluciones más factibles.

This research project sought to carry out a comprehensive analysis of the situation of taxi drivers in terms of the materialization of the right to social security, taking into account those who are in San José de Cucuta. This study is driven from the qualitative approach and from the descriptive typology. These methodological bases, which were complemented with the techniques called documentary analysis and interview, developed results based on recognizing how the legal framework that regulates the integration of taxi drivers from the public taxi service to the Social Security System is composed, in addition to establishing what What does the doctrine say? taking into account that there is an individual work contract, a driver who works as an independent worker and one who is a contractor. Likewise, the conceptions of the leaders of this union in Cúcuta on the scope of the right to social security for them were identified. According to the interviewees, the norms that regulate the generalities on the access to the right to social security should not account for the special characteristics that the profession of taxi driver poses; In other words, the situations related to the link to the. General Social Security System (individual work contract, contractor and independent worker) are not properly defined. For this reason, it was suggested that municipal entities, public land transport service companies in taxi-type vehicles and representatives of the National Government carry out a more in-depth analysis of the scope of the right to social security in this area and thus evaluate the causes. That lead to the failure of full integration into the General Social Security System. With more specific data, it will be possible to base the conversations with better arguments and more feasible solutions.
