El presente trabajo tiene como propósito analizar los factores criminológicos subyacentes en la tipificación del delito del femicidio/feminicidio en Países Iberoamericanos y los diferentes efectos que han tenido estas medidas legislativas y penales en los mismos. Para alcanzar este objetivo, en la investigación se utiliza un método cualitativo mediante la observación del estado del arte existente, bajo un enfoque etnográfico de la cultura patriarcal con arraigo histórico que ocasiona la desigualdad entre hombres y mujeres. El desarrollo de los objetivos propuestos cuenta con la técnica de observación indirecta de leyes preexistentes y textos de investigación realizando un análisis documental describiendo los efectos que ha tenido la tipificación del femicidio/feminicidio en la Región Iberoamericana, logrando determinar que el control social realizado por la comunidad feminista ha conseguido que las Organizaciones Internacionales y los Estados, por recomendaciones de estas, implementen un control social normativo, donde integra la prevención del delito, atención a las víctimas y persecución del autor del hecho configurando la discriminación y la violencia de género un atentado contra los derechos humanos de la mujeres en todas las esferas siendo su mayor expresión la muerte de estas. No obstante, la regulación normativa desarrollada hasta el momento no ha logrado reducir el número de muertes violentas de mujeres aun cuando se advierten textos que pueden cumplir con este objetivo. Las recomendaciones y peticiones de quienes trabajan por el cumplimiento de la Ley es reeducar en el cambio de conciencia frente a patrones culturales de la comunidad en general, pero en especial, de los funcionarios que representan a cada Estado, para lograr la eficacia de la Ley.

The purpose of this work is to analyze the criminological factors underlying the criminalization of femicide / feminicide in Ibero-American countries and the different effects that these legislative and criminal measures have had on them. To achieve this objective, the research uses a qualitative method by observing the existing state of the art, under an ethnographic approach of patriarchal culture with historical roots that causes inequality between men and women. The development of the proposed objectives uses the technique of indirect observation of pre-existing laws and research texts, carrying out a documentary analysis describing the effects that the typification of femicide / feminicide has had in the Ibero-American Region, managing to determine that the social control carried out by the The feminist community has ensured that the International Organizations and the States, by their recommendations, implement a normative social control, which integrates crime prevention, attention to victims and persecution of the perpetrator of the act, configuring discrimination and gender-based violence, an attack against the human rights of women in all spheres, their greatest expression being their death. However, the regulatory regulations developed so far have not been able to reduce the number of violent deaths of women, even though texts that may meet this objective are noted. The recommendations and requests of those who work for the fulfillment of the Law is to reeducate in the change of conscience against cultural patterns of the community in general, but especially, of the officials that represent each State, to achieve the effectiveness of the Law.
