El presente estudio tiene por objetivo analizar el hacinamiento, la vulneración a la salud y las reglas de equilibrio para el resarcimiento de este derecho en el ámbito del Sistema Penitenciario y Carcelario de Cúcuta, a partir de esto inicialmente se decide describir las declaratorias de estado de cosas inconstitucional realizadas por la Corte Constitucional que involucran el quebranto al derecho a la salud dentro del Sistema Penitenciario y Carcelario de Cúcuta, identificar las reglas de equilibrio planteadas por la Corte Constitucional para resarcir el derecho a la salud en el Sistema Penitenciario y Carcelario de Cúcuta y examinar el cumplimiento de las reglas de equilibrio como mecanismo de resarcimiento del derecho a la salud en el Sistema Penitenciario y Carcelario de Cúcuta. En cuanto a la metodología se implementa el enfoque cualitativo, el cual es el mecanismo idóneo para comprender la información que distingue al fenómeno de estudio y transformarla en una teorización precisa, esto a partir del análisis documental y la entrevista como técnicas que ayudan a recoger los datos de una manera más integral para su posterior compenetración. Para que esa aplicación de técnicas sea más completa, se cuenta con los instrumentos denominados matriz de análisis documental y guion de entrevista. Se concluye que en la capital de Norte de Santander, de acuerdo con el pronunciamiento del 2013, se evidencia la existencia de condiciones infrahumanas y distantes de poder garantizar la dignidad humana producto del hacinamiento, igualmente la ausencia de salubridad y de higiene, junto con la vulneración permanente de las demás garantías constitucionales, son la expresión, de acuerdo con la Corte Constitucional, de la falta de capacidad de las autoridades competentes para solucionar esa crisis.

The objective of this study is to analyze overcrowding, the violation of health and the rules of balance for the compensation of this right in the scope of the Penitentiary and Prison System of Cúcuta, from this it is initially decided to describe the declarations of state of unconstitutional things carried out by the Constitutional Court that involve the violation of the right to health within the Penitentiary and Prison System of Cúcuta, identify the balance rules proposed by the Constitutional Court to compensate the right to health in the Penitentiary and Prison System of Cúcuta and examine compliance with the rules of balance as a mechanism to compensate for the right to health in the Penitentiary and Prison System of Cúcuta. Regarding the methodology, the qualitative approach is implemented, which is the ideal mechanism to understand the information that distinguishes the phenomenon of study and transform it into a precise theorization, this based on documentary analysis and the interview as techniques that help collect the data in a more comprehensive way for later understanding. In order for this application of techniques to be more complete, there are instruments called documentary analysis matrix and interview script. It is concluded that in the capital of Norte de Santander, in accordance with the 2013 statement, the existence of inhumane conditions that are far from being able to guarantee human dignity as a result of overcrowding, also the absence of health and hygiene, along with the permanent violation of the other constitutional guarantees, are the expression, according to the Constitutional Court, of the lack of capacity of the competent authorities to solve this crisis.
